Utah Legal Clinic will assist people in handling their own divorce actions.In any county in Utah, a person can legally and easily handle their own simple uncontested divorce, annulment or separate maintenance action. To do so, the case must be completely uncontested; the spouses must be in full agreement as to all terms. It will take about four hours of time to handle your own divorce. The person is responsible for filing his/her own papers, getting a notarized signature from the other spouse, appearing before the judge, if necessary, and presenting the evidence for the divorce.
Utah Legal Clinic will determine if a person should handle his/her own divorce, and provide advice, assistance and a packet of information with all of the completed forms and step-by-step procedure for a person to handle his/her own divorce. The fee for that service is one hundred twenty-five dollars ($125.00) for an action not involving custody of minor children. That amount includes ~30 pages of typing necessary for the divorce. The fee is one hundred seventy dollars ($170.00) for an action involving custody of children which includes ~50 pages of typing. In addition to these fees, there is a one hundred fifty-seven dollar ($157.00) filing fee that must be paid to the Court Clerk to file the case. Utah Legal Clinicwill handle simple uncontested divorces not involving custody of children for a fee of three hundred dollars ($300.00) or a fee of four hundred dollars ($400.00) for simple uncontested divorces involving custody of children. The flat fees mentioned above do not include costs associated with your divorce. In addition to the fees above, you will be required to pay the filing fee of one hundred fifty-seven dollars ($157.00) to our office. Our office will not serve as legal counsel in any legal actions outside of Salt Lake County. If our office handles the matter, we prepare and file all the necessary papers, and handle all contact with the court.
Utah Legal Clinic will handle problem and contested divorces and other domestic relations matters at an hourly rate of two hundred dollars ($200.00) per hour for attorney time and seventy-five dollars ($75.00) per hour for paralegal or law clerk time, plus costs. Our minimum initial non-refundable retainer for a contested domestic relations matter is two thousand dollars ($2,000.00). Unless other arrangements are made in advance, the full retainer must be paid before any work is begun on your case.
